Understanding Canada’s Support for Victims of Family Violence
Canada is committed to protecting vulnerable foreign nationals who are victims of family violence. Under new Ministerial Instructions (MI82), the government has reinforced measures to support victims by offering them a Temporary Resident Permit (TRP). This permit helps regularize their immigration status, granting them legal stay, work or study permits, and access to healthcare.
If you or someone you know is experiencing family violence, Visaserve is here to help. Our legal experts can guide you through the process of applying for a Temporary Resident Permit and securing the protection you deserve.
What Is a Temporary Resident Permit for Victims of Family Violence?
A Temporary Resident Permit (TRP) is a special status granted to foreign nationals in Canada who are suffering from abuse at the hands of their spouse or common-law partner. The permit is issued for a minimum of 12 months and provides crucial protection by:
- Regularizing the victim’s status in Canada
- Providing access to a work permit to support financial independence
- Allowing the victim to apply for a study permit to continue education
- Ensuring access to healthcare through the Interim Federal Health Program
These permits also cover dependent children, ensuring they receive the same protections as the victimized parent.
Who Can Apply?
To qualify for a Temporary Resident Permit for Victims of Family Violence, an applicant must:
- Be physically present in Canada
- Be experiencing abuse from their spouse or common-law partner (physical, sexual, psychological, financial, or neglect)
- Be in a situation where their permanent residency status depends on remaining in an abusive relationship
Victims can be referred by law enforcement (RCMP, Canada Border Services Agency, or local police) or self-identify and apply directly for a TRP.
